Terms of Service

Article 1 Application of these Terms
1. Machiquest Inc. (hereinafter "the Company") establishes these Terms of Service (hereinafter "these Terms") for the use of "Machiquest Pro" (hereinafter "the Service"), which the Company operates.
2. You must agree to these Terms in order to use the Service. By using the Service, you are deemed to have accepted the contents of these Terms.
Article 2 User registration
1. In these Terms, a "user" means a person who has accepted these Terms, applied to register for the Service in the manner prescribed by the Company, and been approved by the Company.
2. The Company may refuse registration where it determines that the registration falls under any of the following.
2-1. Where the applicant does not exist.
2-2. Where the applicant has already registered as a user under another account.
2-3. Where the applicant has previously been suspended from the Service for breach of these Terms or otherwise.
2-4. Where the details declared in the application contain a false statement, an error, or an omission.
2-5. Where the Company otherwise determines that it is inappropriate to grant eligibility to use the Service.
Article 3 Registration information
1. Users shall use the Service with the account and password they registered for the Service.
2. Users shall manage the account and password they registered for the Service at their own responsibility.
3. If any of the details entered when applying to register with the Company change, the user shall promptly notify the Company of the change.
4. If a user forgets the account or password registered for the Service, or becomes aware that it has been leaked, the user shall promptly notify the Company.
5. The Company accepts no responsibility where a notice or other communication from the Company is delayed, fails to arrive, or is not performed because the user did not give notice of a change.
6. Where a user registers an account with an email address, the Company shall handle the registered email address under strict management.
7. Except where caused by the Company's willful misconduct or gross negligence, the Company accepts no responsibility whatsoever for any damage arising from the use of an account and password by a third party.
Article 4 Withdrawal
To withdraw registration for the Service, the user shall notify the Company in accordance with the prescribed procedure. Withdrawal takes effect once the Company has completed the withdrawal process.
Article 5 Prohibited conduct
Where the Company determines that a user's conduct falls under any of the following, the Company shall take such measures as are necessary, including deleting registration information, suspending eligibility to use the Service, and claiming damages.
1. Conduct contrary to public order and morals.
2. Conduct connected with criminal activity.
3. Conduct that infringes the copyright or other intellectual property rights of another user or a third party.
4. Conduct that infringes the property, privacy or similar rights of another user or a third party.
5. Conduct that defames another user or a third party.
6. Conduct for the purpose of soliciting for organizations, services or activities unrelated to the Service.
7. Pre-election campaigning, election campaigning or similar conduct, and conduct that contravenes the Public Offices Election Act.
8. Conduct for profit other than in a form prescribed by the Company.
9. Conduct of becoming a user more than once by using multiple accounts.
10. Where a false statement is found in the user registration information.
11. Unauthorized reproduction or redistribution of information obtained through the Service or of the contents of email from the Company.
12. Conduct that obstructs the operation of the Service or damages the trust placed in the Company.
13. Conduct amounting to unauthorized access or cracking.
14. Conduct of sharing a single account among several people.
15. Any other conduct determined by the Company to be inappropriate.
Article 6 Ownership of rights
1. Copyright and other intellectual property rights (copyright, design rights, patent rights, utility model rights, trademark rights and the like) relating to the Service shall belong to the Company.
2. Copyright and other intellectual property rights relating to information registered by a user shall belong to that user.
3. The Company may use information registered by a user through the Service without the user's consent, but only where the Company determines this to be necessary. Users shall not exercise their moral rights as authors in respect of the Company's use of such works under this paragraph.
4. The preceding paragraph continues to apply after a user has withdrawn from the Service.
5. If a user withdraws, all information registered by that user within the Service shall be deleted.
Article 7 The Service
1. The Company gives no warranty whatsoever as to the accuracy, objectivity, usefulness or other qualities of the information provided through the Service.
2. The Company may add to, change or discontinue the Service at any time at its discretion.
3. The Company may temporarily suspend the Service for reasons including maintenance, accidents, disasters, fire, power failure and changes in the business environment.
Article 8 Disclaimer of damages
1. The Company accepts no liability whatsoever for damage suffered by a user as a result of using the Service.
2. If a dispute arises between a user and a third party as a result of the user's use of the Service, the user shall resolve it at their own cost and responsibility.
3. The Company accepts no liability whatsoever for damage suffered by a user or any third party as a result of suspension of the Service.
Article 9 Changes to these Terms
These Terms may be revised without prior notice. If a change is made, we will post it within the Service to inform users.
Article 10 Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. If litigation arises between a user and the Company, the Tokyo District Court shall have exclusive jurisdiction in the first instance.
